0. Welcome

Welcome to Sober! These Terms of Use ("Terms") govern your access to and use of the Sober mobile application ("App") developed by Assylbek Issatayev ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Description of the App

Sober is an iOS app designed to help users track sobriety and quit bad habits. It includes features for personal habit tracking and a community journal where users can share experiences, support each other, and post anonymously. The App is for informational and motivational purposes only and is not intended as medical advice.

2. Acceptance of Terms

These Terms form a binding agreement between you and us. You must be at least 13 years old to use the App (in compliance with Apple's age requirements). If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these requirements and agree to comply with all applicable laws.

3. Use of the App

You may use the App only for lawful purposes and in accordance with these Terms. Key rules include:

• No Harassment or Harm: Do not harass, bully, or threaten other users. Respect privacy and avoid sharing harmful or discriminatory content.
• No Spamming: Do not post repetitive, unsolicited, or irrelevant content in the community journal.
• No Illegal Activity: Do not use the App to promote or engage in illegal activities, including sharing content that violates copyrights, trademarks, or other intellectual property rights.
• No Commercial Use: The App does not support ads or commercial promotions. Do not use it for business purposes without our written permission.
• Personal Use Only: The App is for your personal, non-commercial use. Do not copy, modify, distribute, or reverse-engineer any part of the App.

We reserve the right to remove any content or suspend access that violates these rules.

4. User-Generated Content

The community journal allows you to post anonymous entries ("User Content"). By posting User Content:

• You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it within the App.
• You are responsible for your User Content and confirm it does not infringe on others' rights or violate laws.
• We do not endorse or verify User Content and are not liable for it. We may review and remove User Content at our discretion, but we are not obligated to monitor it.

5. In-App Purchases

The App offers optional in-app purchases (e.g., premium features or subscriptions) processed through Apple's App Store. These purchases are governed by Apple's terms and your agreement with Apple. We do not handle payments directly and are not responsible for refunds or disputes—contact Apple for support. Prices and availability may change.

6. Intellectual Property

The App, including its design, code, and content (except User Content), is owned by us or our licensors. You may not use our trademarks, logos, or proprietary materials without permission.

7. Termination

We may suspend or terminate your access to the App at any time, for any reason, including if we believe you have violated these Terms (e.g., misbehavior like harassment). No prior notice is required. Upon termination, your right to use the App ends, but these Terms' sections on liability, disclaimers, and governing law continue to apply.

8. Disclaimers and Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee the App will be error-free, secure, or suitable for your needs.

Important Disclaimer: Sober is not a substitute for professional medical, psychological, or therapeutic advice. It is not designed to diagnose, treat, or prevent any condition. Consult a qualified healthcare professional for personalized guidance on quitting habits or sobriety. We are not liable for any decisions or actions you take based on the App or User Content.

To the fullest extent permitted by law, we (and our affiliates) are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data or profits. Our total liability shall not exceed $100 or the amount you paid us (if any).

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state where Assylbek Issatayev resides, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts of that state. You agree to waive any jury trial rights. In compliance with Apple App Store requirements, you also agree to Apple's guidelines for app usage.

10. Changes to These Terms

We may update these Terms at any time. Changes will be posted in the App or via email if feasible. Continued use of the App after changes constitutes acceptance.
